Presentamos, en primer lugar, una breve descripción de la evolución legislativa del sistema educativo español, para, en segundo lugar, analizar, desde las diferentes leyes publicadas, la condición de la Lengua y Literatura Catalana como asignatura dentro de los planes de estudios reglados, remarcando sobretodo los períodos de enseñanza obligatoria. Dividimos el marco legal en tres apartados: de la Constitución de 1812 hasta la Ley Moyano de 1857, de la Ley Moyano de 1857 hasta la Ley General de Educación de 1970, y de la Ley General de Educación de 1970 hasta la Constitución de 1978. Se realiza después el análisis concreto de la lengua en los textos legales, y se destaca el importante papel desempeñado por la Obra Cultural Balear. Finalizamos con algunas conclusiones. ; This paper, firstly, presents a brief description of legislative developments in the Spanish education system, and then goes on to analyse, based on different published laws, the status of Catalan Language and Literature as a subject in regulated school curricula, with special emphasis on compulsory education. We divide the legal framework into three sections: from the 1812 Constitution to the Moyano Law of 1857, from the Moyano Law of 1857 to the General Education Law of 1970, and from the General Education Law of 1970 to the Constitution in 1978. A specific analysis of the language in legal texts is then performed to highlight the role played by the Obra Cultural Balear. We end with concluding remarks. |
